Wills
A will is a legal document executed according to applicable laws in which a testator (person creating the will) names individuals or organizations that will receive his or her assets after death. Additionally, a will can nominate guardians for minor children of the testator and also typically designates an executor who will manage the estate upon the testator’s death.
Trusts
A trust is a mechanism by which a person, designated as the “trustor,” gives his or her property to another person, usually designated as the “trustee,” to hold the property for the benefit of another person. Three types of trusts include: [1] living trusts; [2] irrevocable trusts; and [3] testamentary trusts. Trusts are often used as an estate planning tool to avoid probate of the estate upon the trustor’s death.
Power of Attorney
A power of attorney is a document used to appoint another person to make property or health care decisions on individual’s behalf if he or she ever becomes unable to do so. Such decisions include management of the person’s assets and the person’s wishes concerning life-sustaining treatment among other health care issues.
Trust Administration
Trust administration is a process used to ensure that a trust complies with certain laws and that the trust is being properly executed. For example, a common task in trust administration is ensuring that the title to assets held in the trust is properly changed. Trust administration also includes the process by which a trustor’s estate is distributed following his or her death.
Probate
Probate is the name of the process the court utilizes to manage the affairs of a decedent’s estate (property). While the process was originally designed to ensure that creditors were paid, today it includes that task and also provides for proper notice to all heirs and provides for the orderly disposition of remaining property and assets.
